Sgt. John Hall said the woman was crossing Ambaum Boulevard near 154th Street when she was hit by a pickup truck. She was rushed to Harborview Medical Center where she was listed in critical condition.

Bothell King County DUI Lawyer: I-405 DUI Defendant has a Past

Bothell King County DUI Lawyer:  I-405 DUI Defendant has a Past

BOTHELL, Wash. -- The driver accused of triggering a six-car crash on an Interstate 405 on-ramp has had driving troubles in the past, KOMO News has learned.
It was on the highest ramp of Interstate 405 that a semi truck lost control and slammed into guard rails and light poles just after midnight on Wednesday. The truck fell on its side, spreading debris all over the roadway and causing at least six other cars to crash.
Troopers say the truck, driven by Anthony Saputski of Rathdrum, Idaho, was headed west on State Route 522, taking the on-ramp onto southbound I-405 when it lost control, taking out the guardrail and several light poles. The roadway was shut down in both directions for hours.
A check of the 30-year-old driver's background shows more than 10 driving violations in Idaho, including three speeding tickets and a DUI from 2001. And just last year in Washington state, Saputski was charged with driving a commercial truck with alcohol in his system. Court records indicate he later pleaded guilty to a reduced charge of negligent driving.
The driver told KOMO News he passed several breathalyzer tests Wednesday morning. But state troopers say they found enough evidence at the scene to investigate Saputski for DUI.

Seattle King County DUI Lawyer: BUI boaters face similar penalties to DUI drivers

Seattle King County DUI Lawyer:  BUI boaters face similar penalties to DUI drivers

The following story is from Komo News in Seattle, Washington.

SEATTLE -- Two boat operators were arrested for investigation of boating under the influence four hours apart in Seattle, King County.  And it turned out, they were both operating the same boat.
Around 1:30 p.m., a boat was stopped for going into restricted area in King County. Officials then arrested the operator, Joseph Dalrymple, for boating under the influence. Police say he told them, "I made arrangements to have a sober person with me so I could drink."
Then, around 5:40 p.m., the same boat was stopped again for going into a restricted area. And again, the boat's operator -- this time Thomas Hutchison, was arrested for investigation of boating under the influence.
Both men were booked into the King County Jail, Seattle.

Marysville Snohomish County Drunk Driving Lawyer: Washington State Patrol wins award for DUI arrests

Marysville Snohomish County Drunk Driving Lawyer: Washington State Patrol wins award for DUI arrests

Congratulations to the Washington State Patrol and their effort to stop drunk driving in Snohomish and King Counties, including the I-5 corridor between Seattle and Everett and the I-405 stretch in the Kirkland, Bellevue, and Redmond area.  Despite my bantering and occasional criticism, they are the acknowledged experts and by and large do a very good job at stopping and arresting DUI drivers or those suspected of drunk driving.

The Washington State Patrol has been named by its peers as the top agency in North America when it comes to getting drunken drivers off the road, KING-5 reports.

The award from the International Association of Chiefs of Police recognizes an agency's "year-round efforts to detect and apprehend impaired drivers and to address impaired driving through policies, officer training, and public information and education," according to state police.

"We consider every DUI arrest a potential life saved," said State Patrol Chief John R. Batiste in a news release. "We never know which drunks will kill, but we know with certainty that some of them will."

State troopers arrest about 20,000 impaired drivers each year, which is about half the number police agencies arrest statewide, according to WSP. Read full story.

Lynnwood Everett Drunk Driving Lawyers: DUI charge dismissed against RFK Jr.'s wife in NY

Lynnwood Everett Drunk Driving Lawyers:  DUI charge dismissed against RFK Jr.'s wife in NY

Robert F. Kennedy Jr.'s wife no longer faces a charge of driving under the influence of drugs in New York's Hudson Valley.

Robert F. Kennedy Jr.'s wife no longer faces a charge of driving under the influence of drugs in New York's Hudson Valley.

A judge says evidence shows Mary Richardson Kennedy was unaware that medications she had taken would impair her ability to drive when she was arrested by state police on Aug. 21, 2010.

She was initially pulled over for speeding on the Taconic State Parkway, but police said they determined she was under the influence of a prescription medication.

Pleasant Valley Town Justice Paul Caltagirone (kal-TAHG'-ah-rohn) dismissed the charge Friday.

He noted in his decision that prosecutors opposed the motion.

Kennedy was arrested one month after a judge suspended her license following her guilty plea of driving while impaired near her Bedford home on May 15.

Everett Snohomish County Drunk Driving Editorial: “Far harsher penalties needed”

Everett Snohomish County Drunk Driving Editorial: "Far harsher penalties needed"

Editorial from the Everett Herald in Snohomish County

Apparently familiarity breeds acceptance, because a deadly scourge continues in our society.
What else explains our failure to make driving under the influence a crime that carries an unimaginably harsh penalty? What explains a three-year maximum sentence for "vehicular homicide"? Does such a law imply that we simply accept that a certain number of us are going to die at the drunken and/or angry hands of others when we drive, bike or walk on our roadways? Does it imply that an individual's "right to drive" is only slightly less important than a person's "right to life"?
Everyone knows that drinking and driving can be deadly. Yet first-time DUI offenders, even those who kill others, are often given a break because they have no previous record. (People with multiple arrests reflect the lack of serious consequences.)
If people faced permanently losing their license for even one DUI violation, we might prevent the anguish of seeing lives and families destroyed -- drivers and victims alike.
A recent sampling:
•In January, Camille Spink, 28, was sentenced to seven years for the 2010 wrong-way crash in Everett that killed Sheena Blair, 24, and Martin "Tony" Ramirez, 19. Luis Reyna and Marco Ortiz, both 18, suffered serious injuries.
In June, William Reardon, 43, was sentenced to three years after admitting he was drunk in August 2010 when he drove his pickup off Highway 99, killing Anita Sharma as she talked with a friend outside a Lynnwood pub.
In June, Theresa Ecklund, 43, out on bail in connection with the December death of a pedestrian, David Johnson, in Marysville, was arrested again on suspicion of drunken driving.
On July 27, Patrick Rexroat, 56, of Snohomish, was charged with vehicular homicide and reckless driving for killing Steve Lacey of Kirkland on July 24 in an apparent road rage/DUI crash. Lacey had nothing to do with the road rage incident.
On July 29, Meghan Stivers, 26, of Lake Stevens, was killed when a man driving a Dodge truck hit her vehicle while trying to elude police attempting to pull him over on suspicion of DUI.
In January, Frank Blair, father of a victim Sheena Blair, 24, who was on track to graduate from college with a degree in criminal justice, told the court:
"I think today's sentencing sends the message that vehicular homicide due to DUI is taken seriously. I hope it also sends a message that you don't have to be a bad person to kill when you're drinking and driving. We hope people will consider all five families and make the decision not to drink and drive."
Harsh penalties would help.

Redmond Kirkland Drunk Driving Lawyer: Washington State Patrol DUI (of tiredness) Press Release Part I

Redmond Kirkland Drunk Driving Lawyer:  Washington State Patrol DUI (of tiredness) Press Release Part I

The following is a Press Release by the Washington State Patrol warning drivers not to drive if they are tired.  It raises an important issue:  If you have had a "little" to drink (ie. 2 to 3 drinks) and drive, are sleepy, then stopped and eventually arrested for DUI with no BAC test, are you driving while under the influence or driving while drowsy?

Getting Enough Sleep Can Save Your Life on the Roads

June 1, 2011

Wenatchee Washington State Patrol (WSP) Captain Karen DeWitt urges you to get enough sleep before making a trip.  Over Memorial weekend, Wenatchee WSP investigated three collisions involving drowsy drivers, two which resulted in fatal injuries and the third resulting in serious injuries to the driver.

The National Highway Traffic Safety Administration estimates that drowsy driving results in 1,550 deaths, 71,000 injuries and more than 100,000 accidents each year. Their study shows that drowsy driving involves about one in six deadly crashes; one in eight crashes resulting in occupant hospitalization, and one in fourteen crashes in which a vehicle was towed.

Warning Signs: Feeling Sleepy? Stop Driving!

If you start to do the following, it's time to get off the road. Find a safe place to pull over:

  • Have problems focusing, blink frequently and/or have heavy eyelids;
  • Drift from your lane, swerve, tailgate and/or hit rumble strips;
  • Have trouble remembering the last few miles driven;
  • Miss exits or traffic signs;
  • Have trouble keeping your head up;
  • Yawn repeatedly;
  • Or finding yourself rolling down the windows or turning up the radio.

Sleepiness can impair drivers by causing slower reaction times, vision impairment, lapses in judgment and delays in processing information. In fact, studies show that being awake for more than 20 hours results in an impairment equal to a blood alcohol concentration of 0.08%, the legal limit in all states. It is also possible to fall into a 3-4 second micro-sleep without realizing it which equates to traveling the length of a football field while unconscious at 65 MPH.

Prevent a fall-asleep crash by getting enough sleep the night before and by knowing the warning signs of sleepiness and using appropriate countermeasures.

National Sleep Foundation's Countermeasures to Prevent Fall-Asleep Crashes

  • Get a good night's sleep before you hit the road. You'll want to be alert for the drive, so be sure to get adequate sleep (seven to nine hours) the night before you go.
  • Don't be too rushed to arrive at your destination. Many drivers try to maximize the holiday weekend by driving at night or without stopping for breaks. It's better to allow the time to drive alert and arrive alive.
  • Use the buddy system. Just as you should not swim alone, avoid driving alone for long distances. A buddy who remains awake for the journey can take a turn behind the wheel and help identify the warning signs of fatigue.
  • Take a break every 100 miles or 2 hours. Do something to refresh yourself like getting a snack, switching drivers, or going for a run.
  • Take a nap—find a safe place to take a 15 to 20-minute nap, if you think you might fall asleep. Be cautious about excessive drowsiness after waking up.
  • Avoid alcohol and medications that cause drowsiness as a side-effect.

Avoid driving at times when you would normally be asleep.
Consume caffeine. The equivalent of two cups of coffee can increase alertness for several

Washington State DUI Lawyer: The DUI Investigation Handbook

Washington State DUI Lawyer:  The DUI Investigation Handbook

The following is an excerpt from the recently published The DUI Investigation Handbook.  This most valuable DUI Investigation book details in its 145 pages the entire DUI Investigation process law enforcement officers use to detect and investigate DUI drivers.  The DUI Investigation Handbook is available at over 100 locations including Barnes and Noble and Amazon.com.  David N. Jolly is the author of 5 DUI books and the first DUI App for iTunes in the United States.  His next book, The Drug DUI Handbook, is due for release in September, 2011, and is the first book of its kind in the United States.  Look for excerpts in late August, 2011.

How to Interpret the Walk and Turn Test

Instructional Stage

Two clues apply during the "instructional stage" that occurs while the suspect is standing heel-to-toe and listening to the instructions:

• One clue that is observed by the officer is whether the subject fails to keep balance (i.e. suspect breaks away from the heel-to-toe stance). Swaying or using arms for balance is not considered a clue at this point; and

• The second clue observed by an officer prior to the walking stage is whether the subject starts walking too soon (i.e. suspect starts walking before you say "begin").

Walking Stage

The remaining six validated clues occur during the walking stage of the test. They are follows:

• Stops walking (i.e. the subject pauses for several seconds).

• Misses heel-to-toe (i.e. more than 1/2 inch gap).

• Steps off the line (i.e. the foot must be entirely off the line).

• Raises the arms while walking (i.e. more than 6 inches).

• Takes the wrong number of steps.

• Turns improperly.

PHASE THREE:  FIELD SOBRIETY TESTS

Phase Three of the pre-arrest screening in the DUI investigation process has two major evidence gathering tasks and one major decision, according to NHTSA. The officer's first task in Phase Three is to administer three psychophysical (field) sobriety tests. NHTSA declares that these tests are "scientifically validated" however, this assertion is not universally accepted and will be detailed later in the chapter. Importantly these tests are voluntary and the officer must inform the driver of this fact. NHTSA states that based on these tests and on all other evidence gathered from Phase One and Two, the officer must decide whether there is sufficient probable cause to arrest the driver for DUI.

Alcohol/Drug impairment OR medical issue?

A well trained DUI officer should be aware that a driver who exhibits signs of alcohol or drug impairment may actually not be impaired by either. There are instances when a driver who exhibits such signs may indeed be suffering from a medical condition and not alcohol or drug impairment. In cases such as these the officer should be aware of medical conditions that need attention for the welfare of the driver and/or alternatively, to ably distinguish the observations from alcohol or drug impairment.

Medical conditions may manifest themselves as slurred speech, confusion, lack of coordination, difficulty walking, poor memory and poor balance. Such conditions may be observed upon contact with the driver and may make performing the field sobriety tests impossible or the result unreliable. It must be noted that some of these medical conditions may ultimately prohibit individuals from driving but early stages of medical conditions or certain diseases may permit individuals to drive.
