Dick's DUI Driver Former University of Washington Professor

Police say 73-year-old Colin Sandwith was drunk when he plowed his SUV into the Lake City Dick's Drive-in around 9:20 p.m. on March 25th.
He pleaded not guilty to a DUI charge on Saturday.

Can Potential Employers see if I've been charged with a Snohmish County DUI, King County DUI, Skagit County DUI, Island County DUI or Completed a Diversion Program?

Washington State schools chief sorry for DUI

The state's head of schools, Superintendent Randy Dorn, sent an apology to reporters today for his actions over the weekend.
Dorn, 56, was arrested early Sunday for suspicion of driving under the influence.
His statement today explains more of his actions:
I understand the public wants to know more about my recent citation. I am not at liberty to discuss the legal aspects of this case, but I can now share more information.
First and foremost, I want to apologize for what happened last Saturday night. My wife, our sons and I attended the annual crab feed and dance at Swiss Sportsman Club Park in Bonney Lake. My family has long supported the club. As members, we stayed late to help clean up the hall. I drank beer during the event, but I thought I was capable of driving home. I now know that drinking any amount of alcohol before driving is an extremely poor choice.
Today, my attorney has asked the city of Orting to release all the documents regarding this case because the public has a right to see this information. I am pleased the court has moved my hearing date from Monday, April 6, to Friday, April 2, to begin to address this matter sooner.
This week, I have continued to do the job the people of this state elected me to do. This morning I attended an important meeting with Gov. Chris Gregoire regarding our state's application for the federal "Race to the Top" grant. Next week, I will take a long-planned vacation with my wife – a school librarian who will be on spring break.
Again, I want everyone to know how sorry I am for what happened on Saturday. I have caused hurt and embarrassment to my family and I have disappointed my supporters and my staff. I work hard every day for the school children of this state and it pains me deeply that I have not set a good example for them. I will work hard to earn back your trust and I pledge that I will never make this mistake again.

Island County to lose Prosecuting Attorney Position - will this affect your Island County DUI?

Months ago the Island Prosecuting Attorney’s office declared that they would have to eliminate a prosecuting attorney position due to budget cuts.  This is disappointing to most in the legal community because it means that in all likelihood a well trained prosecutor will no longer be prosecuting cases in Island County District Court.  Further, a good person will be lost due to lack of money.  Because of this removal of a prosecutor the remaining prosecuting attorneys will have to shoulder more of a load.  This will undoubtedly put pressure on their office as it is unlikely the number of cases filed will decrease.

It is interesting that politicians campaign on being tough on crime and DUIs yet the budget results in cutting a valuable resource that helps prosecute those charged with DUI.  The result of one less prosecutor in a very small prosecuting attorney’s office will no doubt result in more DUIs being amended to less severe offenses.  How could it not?  As a DUI attorney I will, and my office will, continue to push every case to its limits and we will certainly not back off simply because the prosecutor’s office has fewer prosecutors.  Interesting times in Island County and DUI defense lie ahead.

Six injured in DUI crash in King County

 

Six people were injured Saturday night when a Toyota Celica crashed into a Chevy Impala at 23rd and King.Seattle police say the incident happened around 8:10 p.m.  The Celica was traveling was traveling south on 23rd when it went to make a left turn.  In the process of making the turn, it crashed...more into the side of the Impala, which was traveling north on 23rd.The impact of the crash sent the Impala out of control, go over a curb on the east side of 23rd and hit a tree broadside.  The car bounced off the tree and came to rest straddling the curb and street.There were five people in the Impala and one person in the Celica.  All were taken to Harborview for treatment.  One woman in the Impala suffered a fractured ankle and a fractured jaw.  Another woman in the Impala had a fractured pelvis.  All others had minor injuries, police said.The driver of the Celica was evaluated for impairment while at Harborview.  A SPD DUI recognition officer said she exhibited signs of intoxication...

On March 26, 2010, a driver accidentally crashed his SUV into the front of Dick's Restaurant. A witness told police he was standing in line at the restaurant at 12325 30th Ave North when he turned and saw the vehicle driving towards him. He jumped out of the way, injuring his knee. The driver got out and said that he hit the accelerator instead of the brake. Officers arrested the driver, processed him for DUI and later released him. He was not injured. The folks at Dick's say the damage will take at least a week to repair. It will be closed until further notice.

Stopped for a King County DUI, Snohomish County DUI, Skagit County DUI, or Island County DUI? Did You Know Your Passengers are Allowed to Calmly Leave the Scene?

Lovejoy, Attorney at Law - Does the Washington Constitution Article I, § 7 permit the police to detain a passenger in an automobile at the scene of a traffic infraction if the passenger wishes to depart, the police lack reasonable suspicion the person is engaged in criminal activity, and the person poses no apparent danger to the officer?  The simple answer is no. see  State v. Mendez, 137 Wn.2d 208 (1999).  In the Mendez case, Yakima police lawfully stopped a car in which Efrain Mendez was a passenger.  Once the car came to a stop, both the driver and Mendez got out of the car, and Mendez began to walk away.  When the police ordered Mendez to return to the car, he started to run.  When the  police finally caught up to Mendez, they found a pipe used to smoke marijuana in his pants pocket, and he was charged with possession of drug paraphernalia.   In this case, the Washington Supreme Court attempts to strike an appropriate balance between the concern for officer safety and the constitutional privacy interests of passengers who are not suspected of committing a crime.  As a passenger, Mendez was not stopped on suspicion of criminal activity.  Further, the officers failed to articulate how, by walking away from the traffic stop, Mendez posed a danger to the officers.  Since the police had no probable cause to stop Mendez after he left the vehicle, the Washington State Supreme Court ruled the marijuana pipe obtained from the search must be suppressed.

Washington State Trooper Arrested for DUI - Then Tries to Cover it up!

OLYMPIA, Wash. - A veteran Washington State Patrol Sergeant was arrested for investigation of driving under the influence (DUI) and trying to have it covered-up.

According to the WSP, Sgt. Coy Christopher Clark was off-duty and driving his personal car down Canyon Road near Puyallup at about 3:30 a.m. Saturday morning when he went off the road near 104th Street E. Clark's car became stuck so, according to the Patrol, he called fellow, on-duty, trooper Adan Gruener to the scene.

Attn : Snohomish, Island, Skagit, King County DUI Suspects : DUI Tip From Anonymous Informant Does Not Justify Investigative Stop of Your Vehicle

Lovejoy, Attorney at Law – A vehicle cannot be stopped because an anonymous citizen reported that the driver was intoxicated.  The citizen must first identify themselves and volunteer facts that support their allegation.  The circumstances must suggest (1) that the informant is reliable, and (2) that the information relayed is supported by objective facts which the police officer can evaluate for accuracy.  Otherwise, the stop of the vehicle is improper, and the DUI must be dismissed.  See  Campbell v Department of Licensing, 31 Wn. App. 833, (1982).

Lovejoy, Attorney at Law – A vehicle cannot be stopped because an anonymous citizen reported that the driver was intoxicated.  The citizen must first identify themselves and volunteer facts that support their allegation.  The circumstances must suggest (1) that the informant is reliable, and (2) that the information relayed is supported by objective facts which the police officer can evaluate for accuracy.  Otherwise, the stop of the vehicle is improper, and the DUI must be dismissed.  See  Campbell v Department of Licensing, 31 Wn. App. 833, (1982).

An officer stopped the car in the 2700 block of Commercial Avenue for a burned out taillight. The driver, a 22-year-old Hope Island man, smelled strongly of alcohol and had slurred speech and bloodshot eyes. He allegedly admitted drinking at a bar in Bellingham. He failed field sobriety tests and was arrested on a charge of DUI. He provided breath samples more than twice the legal limit. He was cited and released to a sober friend. Court date for this Skagit County DUI is pending.

In Skagit County, Anacortes Police contacted a 45-year-old man at his home in the 500 block of Hillcrest Drive after a witness reported his car was driving very aggressively and almost hit her vehicle on Highway 20 around 6:24 p.m. The man came to the door naked. He was hostile and screamed at officers to get off his property. He smelled of alcohol and ignored repeated requests to put on clothes while yelling expletives.
He was told he was under arrest, but pulled away and slammed the front door. His father allowed officers inside, saying he was alarmed by his son’s behavior. When the man was eventually taken into custody he allegedly admitted driving his car on the highway, then provided breath samples significantly over the legal limit. He was cited on charges of DUI, resisting arrest and disorderly conduct, then released to his father.

Both vehicles were extensively damaged and the offending car was unable to drive away. The driver, a 17-year-old Anacortes girl, was unsteady on her feet as she got out of the car and allegedly admitted she didn’t have a driver’s license. She smelled of alcohol, had bloodshot eyes and her speech was slurred.
She allegedly admitted drinking but would not perform field sobriety tests, saying the officer should just arrest her. She was arrested on a DUI charge. Her license was suspended for a previous alcohol violation. She was uncooperative during processing but eventually provided breath samples almost twice the legal limit. She reportedly took the car she was driving without the owner’s permission after leaving a party on Hillcrest Drive. Anacortes, Skagit County man faces DUI charge after driving in Hospital Parking Lot

According to the Anacortes American, a 74-year-old Anacortes man faces a DUI charge after hitting several cars in the hospital parking lot before going in for a scheduled medical procedure.

A witness said the man backed his pickup into a parked car, then pulled forward and sideswiped another parked car around 9:30 a.m. Friday, March 12. He then walked into the medical building.

An officer learned the driver was scheduled for a medical procedure that reportedly was canceled because he drank to the point where he didn’t know what day it was. He smelled strongly of intoxicants, had slurred speech and was unbalanced. He denied hitting any parked cars, but allegedly admitted he had “a bit to drink.” When the officer pointed out the damage to his pickup and the other vehicles, the driver agreed he must have hit them.

He allegedly failed field sobriety tests and leaned against a fence to maintain his balance. He provided breath samples three times the legal limit. He was cited on charges of DUI, hit and run and having no insurance.

American Idol Star Sanjaya drove 110 mph and Isn't facing Reckless Endangerment Charge. How about Reckless Driving?

Lovejoy, Attorney at Law – http://seattletimes.nwsource.com/html/entertainment/2011439631_apuspeoplespeedingidol.html  Washington State Trooper MacDonald may be right; there may not have been anyone else on the freeway at 2:30 a.m. when Sanjaya was stopped for driving 110 mph in a 60 mph zone.  And according to the Revised Code of Washington (RCW 9A.36.050 to be exact), which describes Reckless Endangerment as “reckless… conduct… that creates a substantial risk of death or serious physical injury to another person” (emphasis added), Sanjaya may not be guilty of Reckless Endangerment.  But what about charging him with Reckless Driving?  RCW 46.61.500 describes someone guilty of Reckless Driving as “any person who drives any vehicle in willful or wanton disregard for the safety of persons or property.”  Both crimes are gross misdemeanors, but if found guilty of Reckless Driving Sanjaya would automatically lose his license for 30 days (RCW 46.61.500).

BAC Test Results for DUI Cases now Reliable says King County Prosecutor! Really?

After you read the following article remember this:  when the issue regarding the toxicologist’s office first arose more than two years ago the toxicology lab and the prosecutor’s office (King County, Snohomish County, Skagit County, Island County)  all declared that everything was “okay” and that BAC tests were therefore valid.  However, it was found that the toxicology lab and their employees had lied about validating simulator solutions and that some of their employees had actually committed perjury.  Yet, the prosecutor’s offices though-out the State and the toxicology office all declared that despite the known issues that BAC readings were still valid!  The old adage “good enough for government work” was alive and well.

Thankfully Judges in King County saw the problem and ordered that all BAC tests be suppressed.  Judges in Snohomish County agreed and suppressed all BAC results in DUI cases.  Skagit County Judges compromised and despite their obvious lean toward the prosecutor’s office did suppress certain BAC tests in DUI cases.  Island County judges did not agree, for reasons unknown (although reputation declared their decision not surprising) they decided that despite the obvious problems, lying, and perjury, that BAC tests were valid.  Go figure!

BAC Test Results for DUI Cases now Reliable says King County Prosecutor! Really?

After you read the following article remember this:  when the issue regarding the toxicologist’s office first arose more than two years ago the toxicology lab and the prosecutor’s office (King County, Snohomish County, Skagit County, Island County)  all declared that everything was “okay” and that BAC tests were therefore valid.  However, it was found that the toxicology lab and their employees had lied about validating simulator solutions and that some of their employees had actually committed perjury.  Yet, the prosecutor’s offices though-out the State and the toxicology office all declared that despite the known issues that BAC readings were still valid!  The old adage “good enough for government work” was alive and well.

Thankfully Judges in King County saw the problem and ordered that all BAC tests be suppressed.  Judges in Snohomish County agreed and suppressed all BAC results in DUI cases.  Skagit County Judges compromised and despite their obvious lean toward the prosecutor’s office did suppress certain BAC tests in DUI cases.  Island County judges did not agree, for reasons unknown (although reputation declared their decision not surprising) they decided that despite the obvious problems, lying, and perjury, that BAC tests were valid.  Go figure!

Special Requirements for Deferred Prosecution in Snohomish County DUI

Lovejoy, Attorney at law - Snohomish County has strict requirements for those charged with a DUI who are applying for the Deferred Prosecution program.  For example, seven (7) days prior to proposed entry, a petition must be filed with both the Prosecutor, and the Court’s Probation Department.  Furthermore, before an Order deferring prosecution can be granted, the accused must complete thirty-six (36) hours of Phase I Treatment.

ARIDE-trained Washington State Trooper nails driver on I-405 for DUI

A trooper who had recently been trained in better recognizing impaired drivers got to use his training Wednesday morning on I-405.
The Washington State Patrol put out a media release on Wednesday night talking about four DUIs that were caught Wednesday morning by King County-based troopers trained in Advanced Roadside Impaired Driving Enforcement (ARIDE) techniques.  ARIDE classes help officers become more proficient in detecting, testing and apprehending impaired drivers.
One of those four King County stops was on southbound I-405 inside Bothell.  A trooper stopped a car that was making unsafe lane changes.  The driver, a 23-year-old from Everett, was arrested for DUI and possession of marijuana.  The arrest was made at 11:20 a.m.
WSP says there are 50 troopers in King County who have ARIDE training.

Drunken Sailer bites Seattle, King County Cop then Arrested for DUI

Police arrested a drunken sailor who bit a police officer at Seattle Center early Thursday morning.
Officers responded to a call from Seattle Center security at about 1:25 a.m. Security workers had detained two men for crashing through bollards meant to keep vehicles out of Center grounds.
Both men were drunk, and when an officer attempted to take one of them into custody for DUI, he resisted arrested, kicked at the officers and bit one of them on the hand, according to police.
